Welcome to QBAY SMS Gateway provided by QBAY. By using our SMS Gateway services available at QBAY SMS Gateway, you agree to comply with the following Terms of Use.

1. Acceptance of Terms

By accessing or using QBAY SMS Gateway, you agree to be legally bound by these Terms of Use, our policies, and any applicable laws and regulations of Sri Lanka.


2. Description of Service

QBAY provides an online SMS Gateway platform that allows customers to send transactional, promotional, and notification SMS messages to recipients through telecom operator networks.


3. User Responsibilities

You agree that you will:

  • Use the service only for lawful and legitimate business purposes
  • Obtain proper consent from recipients before sending promotional SMS
  • Ensure message content complies with telecom regulations and local laws
  • Maintain confidentiality of your account credentials
  • Be fully responsible for all messages sent from your account


4. Prohibited Content and Usage

You must NOT use QBAY SMS Gateway to send messages that contain:

  • Illegal, fraudulent, or misleading content
  • Spam or unsolicited bulk messages without consent
  • Offensive, abusive, hate, or adult content
  • Content related to gambling, drugs, or prohibited services
  • Political or religious campaigning messages without prior approval
  • Any content that violates regulations of telecom providers in Sri Lanka

QBAY reserves the right to suspend accounts immediately for such violations.


5. Sender ID Policy

  • Sender IDs must comply with telecom operator guidelines
  • QBAY reserves the right to modify or reject any Sender ID request
  • Alphanumeric Sender IDs may require documentation and approval
  • Sender ID misuse may result in service suspension


6. Delivery and DLR (Delivery Reports)

  • SMS delivery depends on telecom operator networks
  • QBAY does not guarantee 100% delivery
  • Delivery reports (DLR) are provided based on operator feedback


7. Payment and Credits

  • SMS credits must be prepaid
  • Credits are non-refundable and non-transferable
  • Credits have validity based on the purchased plan
  • QBAY may revise pricing at any time without prior notice


8. Account Suspension or Termination

QBAY may suspend or terminate your account if:

  • These terms are violated
  • Suspicious or abusive activity is detected
  • Required documents are not provided for Sender ID approval
  • Payment disputes occur


9. Data Privacy and Confidentiality

QBAY respects customer data privacy. Message content and customer data will not be shared with third parties except when required by law or telecom authorities.


10. Limitation of Liability

QBAY shall not be liable for:

  • Delays or failures in SMS delivery due to operator issues
  • Losses arising from message delays or non-delivery
  • Indirect or consequential damages


11. Changes to Terms

QBAY reserves the right to update these Terms of Use at any time. Continued use of the service implies acceptance of the updated terms.


12. Governing Law

These Terms shall be governed in accordance with the laws of Sri Lanka.
